A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was detained in federal custody.
