The ninth circuit court has maintained a prohibition on sending national guard in the Oregon city, after a latest legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court ruled on Tuesday that it would reexamine the case concerning the executive power with an larger panel of 11 judges. The judicial body also overturned a previous ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a long-running legal battle over whether the former president has the authority and justification to send national guard forces in Portland. Approximately 200 federalized guard members have been in uncertainty since the end of September when the mobilization attempt was initiated in response to ongoing demonstrations.

Differing Viewpoints

The federal government has argued that federal officials at the immigration center in the southern part of the city were facing threats, while local authorities maintain that municipal police have command of the circumstances.

Contrary to descriptions of Portland as “war ravaged”, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a federal judge in Portland enacted two legal injunctions this month – one blocking the federalization of the Oregon national guard, and another stopping the deployment of any national guard troops in the state, after attempts to circumvent the initial injunction by calling up troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – permitting command of state troops – but the second ruling stayed effective, blocking the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard “en banc” – with all decisions under review together – by a group of eleven justices.

“This ruling shows that the truth matters and that the judicial system are striving to hold this administration accountable. The constitution restricts the executive authority, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a definite signal: the executive leader cannot dispatch the military into American urban areas unnecessarily. We will continue defending state legislation, values, and sovereignty as this legal proceeding progresses and our legal battle continues in the courts.”
